Captain Tait v Colonel Poneskis and Ministry of Defence

Judgment in the Respondents’ costs and wasted costs application in the case of Captain Tait v Colonel Poneskis and Ministry of Defence (Central London Employment Tribunal) has been handed down. Having dismissed the claims of sexual orientation discrimination arising from the Claimant’s deployment to Afghanistan at a trial in 2011, the Tribunal has awarded the Respondents two thirds of their costs of £80,000 to be assessed. The Claimant is to pay 40% of the sum on the standard basis and an order for wasted costs has been made against her representative (to pay 60% of the total). The Respondents were represented by David Mitchell.
