Fox -v- Kensington & Chelsea College

Michael Salter successfully defended the well-known college who dismissed a tutor after he was excluded from working on their client’s sites. The case, which received international media coverage, was heard over two-days in London South Employment Tribunal. The Claimant was excluded by the authorities at Young Offenders Institute Isis after it transpired that one of the students in his class attempted to hack the mainframe server on six-occasions without challenge. The Claimant was cleared by the Respondent of any misconduct after a disciplinary process but was refused permission by the Y.O.I. to return on site. Describing the Claimant’s complaints as “inchoate” the Employment Judge found that the Respondent had undertaken everything it needed to “in treating the complicated and carefully considered circumstances of this case as appropriate to result in dismissal”
