Catherine Urquhart defeats QC in constructive dismissal case

Mrs Phillips was employed by Randox Health Checks Limited, a subsidiary of Northern Ireland-based Randox Laboratories, to set up and run a health clinic in London. After the successful launch of the clinic in 2012, Mrs Phillips complained that her duties had been unilaterally altered and that, in effect, she had been demoted from the head of the London business to a pure sales role. She resigned and brought a complaint of constructive unfair dismissal.

The case was heard over six days in April 2014 at the Central London Employment Tribunal, by Employment Judge Tayler with the Respondent represented by Leading Counsel. The Employment Judge found that Mrs Phillips had been constructively dismissed, as she been demoted to a sales job, her reporting line had been altered from the Managing Director to his private secretary, and she had been given unrealistic targets. He also found that when Mrs Phillips had raised a grievance about these matters, she had been harassed by a barrage of unfounded complaints being brought against her by members of the Respondent’s staff.
