Caste Discrimination

Will caste become a protected characteristic under the Equality Act 2010? This issue was considered in the cover story on caste discrimination in the 13 February 2015 edition of New Law Journal, written by Ely Place barrister Catherine Urquhart.

The article looked at proposals by the Government to amend the Equality Act to bring in this change, as well as the recent Employment Appeal Tribunal judgment in the case of Chandhok v Tirkey [2015] All ER (D) 91 (Jan), the first time the EAT has considered caste discrimination. (The appellants in that case were represented by Ely Place barristers John Samson and Aidan Briggs, and a report of the case is found here.)

The article also looked at the potential difficulties facing employers in understanding how caste discrimination may arise and how to combat it in the workplace. A transcript of the article can be found here.
