Houchin -v- Lincolnshire Probation Trust

Alan Houchin, who was serving a life sentence for murder, brought proceedings for misfeasance in public office against the Lincolnshire Probation Trust alleging that one of its officers had acted maliciously in engineering his regression to closed conditions.

Following a 3 day summary judgment application the claim was dismissed with Mr Justice Supperstone finding insufficient evidence to support the allegation of malice.
