Richard Clayton QC gives lecture on recent developments in commercial law to Law Association of Trinidad and Tobago

The Law Association invited Richard to lecture them on commercial law last month. Richard lecture covered the implications and effect of some recent important Supreme Court decisions. His paper analysed:

  • the enforceability of contractual ‘no oral variation’ clauses (Rock Advertising Ltd v MWB Business Exchange Centres Ltd [2018] 2 W.L.R. 1603);
  • the new approach to the law of unlawful means conspiracy (JSC BTA Bank v Ablyazov (No 14) [2018] 2 W.L.R. 1125);
  • the enforceability of penalty clauses (Cavendish Square v Makdessi [2016] A.C. 1172); and
  • apparent bias in the commercial context (Almazeedi v Penner [2018] UKPC 3).
